Many aspiring inventors believe success starts with patents, prototypes, or pouring money into product development. That’s where many people go wrong. The smartest invention journeys begin with validation—not spending.

Before investing time and money, ask the right questions:

• Does this solve a real problem?

• Who would buy it?

• Is there already something similar on the market?

• Can it be produced at a cost people will pay for?

Too often, inventors fall in love with the idea before confirming demand. Fried emphasizes that a great concept is only the beginning—the real opportunity comes when an idea can become a profitable product.

Tips When Disclosing Your Idea to Others

Sharing an invention can be exciting, but before presenting your idea to others, it is wise to secure basic intellectual property protection. Many inventors start by filing a Provisional Patent Application (PPA), which allows them to use the term “patent pending” for up to one year while exploring licensing, manufacturing, or market interest.

A provisional patent application acts as a temporary placeholder. It gives you an early filing date but does not include the full legal claims of a utility patent. During that one-year period, inventors can test prototypes, gather feedback, and improve their design before deciding whether to move forward.

It is also important to know exactly what type of protection you have. Some inventors believe they already “have a patent” when they only have a provisional filing. Others may have filed a non-provisional application or a design patent. Understanding your filing status and deadlines is essential.

Before the one-year provisional term ends, inventors must decide whether to file a Non-Provisional Patent Application, also called a utility patent. This application contains claims that define what is legally protected. Missing the deadline may result in losing important rights.

For inventions focused mainly on appearance, a Design Patent may be the better option. Design patents protect ornamental features, while utility patents protect how an invention works.

Many inventors choose to work with a patent attorney or patent agent. Attorneys can handle legal disputes and court matters, while agents are licensed to prepare and file patent applications. Costs can vary, so comparing quotes and checking experience is a smart business move.

While it is possible to file on your own, professional guidance can help avoid costly mistakes. Since intellectual property is often the key asset in licensing or launching a product, protecting your idea properly is one of the smartest first steps you can take.

Advice from an Inventor

INVENTION HISTORY: On May 1, 1888 - Patent #382,280 was granted to Nikola Tesla for the "electrical transmission of power."

In April 1887, Tesla, along with his investors, Western Union telegraph superintendent Alfred S. Brown and attorney Charles F. Peck, founded the Tesla Electric Company in New York City for the purpose of developing new types of electric motors and generators.

Tesla soon developed a new type of electromagnetic induction motor that ran on alternating current. Patented in May 1888, Tesla’s motor proved to be simple, dependable, and not subject to the constant need for repairs that plagued direct current-driven motors at the time.

In July 1888, Tesla sold his patent for AC-powered motors to Westinghouse Electric Corporation, owned by electrical industry pioneer George Westinghouse. In the deal, which proved financially lucrative for Tesla, Westinghouse Electric got the rights to market Tesla’s AC motor and agreed to hire Tesla as a consultant.

With Westinghouse now backing AC and Edison backing DC, the stage was set for what would become known as “The War of the Currents.”

What is copyright registration?

Copyright registration is the official process of recording your creative work with the U.S. Copyright Office to strengthen and formalize your legal rights as the owner.

While copyright protection exists automatically when an original work is created and fixed in a tangible form, owners can take important steps to enhance those protections. The most important of these is registering the work.

Registration is not mandatory—but for U.S. works, registration (or refusal) is required before you can enforce your exclusive rights in court. In other words, if someone infringes on your work, you generally cannot file a lawsuit until your copyright is registered.

Timely registration also provides significant legal advantages. It allows copyright owners to pursue certain types of monetary damages and attorney’s fees in litigation, and it creates a legal presumption that the information on the registration certificate is accurate.

Beyond individual protection, copyright registration benefits the public as well. It supports the licensing marketplace by making ownership information accessible, provides public notice that a work is protected, and contributes to a formal record of the nation’s creative output.

There is only one place to register claims to copyright in the United States: the Copyright Office.

INVENTION HISTORY: On April 2, 1889, Charles Martin Hall patented an inexpensive method for the production of aluminum, which brought the metal into wide commercial use.

Before 1886, aluminum was so rare and expensive that it was considered a precious metal — costing more than silver and used only for ornamental pieces. That all changed when Charles Martin Hall, a young chemist who had just graduated from Oberlin College, invented an inexpensive method for producing aluminum using electrolysis. His process made it possible to extract aluminum from its ore affordably and on a large scale, launching the modern aluminum industry.

Hall’s breakthrough laid the foundation for aluminum to become one of the most widely used materials in the world — from aircraft components to beverage cans — due to its light weight, strength, and resistance to corrosion.

The number one knock on private credit has always been the same: you can't get out. Lock in for 12 or 24 months, hope things go as planned, wait. Percent changed that in December 2025 with a secondary marketplace. Browse live bid and ask data on seasoned deals, submit an indication of interest to buy or sell, and Percent coordinates the match. For accredited investors who want private credit yields without locking up capital indefinitely, you can do that now. Understanding Royalties, Distribution, and Smart Licensing Decisions

One of the most important—and often misunderstood—aspects of licensing your invention is how royalties work across different distribution channels. Not all sales are created equal, and understanding the math behind them can help you negotiate smarter deals.

In many traditional retail situations, a licensee sells a product wholesale to a retailer, who then marks it up for consumers. For example, if a product wholesales for $4 and retails for $8.99, your royalty as the inventor (licensor) is typically calculated on the $4 wholesale price. Royalty rates commonly range from 2% to 10%. At a 5% royalty, you’d earn $0.20 per unit. That might not sound like much—until scale kicks in. If a major retailer orders 100,000 units, that’s a $20,000 royalty payment to you.

Direct-to-consumer channels, such as infomercials or radio advertising, may involve different royalty structures. While there may be no wholesaler, there are other costs to consider, including advertising and airtime expenses. Each channel has its own financial dynamics, and those differences matter when negotiating terms.

Smaller or independent distribution channels may offer higher margins for the licensee, which could open the door to negotiating a higher royalty rate. However, those channels usually sell fewer units. The “right” royalty rate depends on many factors—product category, typical margins, and where and how the product will be sold.

As the inventor, you own the intellectual property, and any licensing agreement should clearly define key terms such as:

• Length of the agreement (term)

• Geographic territory (regional or global)

• Royalty rate and payment terms

• Minimum sales guarantees or projections

• Exclusivity conditions

You may also discuss an advance payment against future royalties as a sign of the licensee’s commitment. Every agreement is different, and flexibility is often necessary to make a deal work. The goal is fairness, clarity, and aligned expectations—just like any good partnership.

Keep in mind, when you license your invention, you give up some control over marketing, pricing, and distribution. That’s the tradeoff for working with companies that already have strong buyer relationships and deep market experience.

If your product includes a licensed brand or character, margins may be lower because the licensee must pay royalties to multiple licensors. However, recognizable characters or brand names can significantly boost sales volume. While the royalty per unit might be smaller, the overall return can be much larger due to increased demand.

The bottom line: always make sure you have an experienced attorney or qualified licensing consultant representing you. Licensing can be complex, and having the right guidance helps protect your invention—and maximize its potential.

Inventor Insight: Claiming Your Idea

Before investing serious time, money, and energy into an invention, it’s critical to determine whether your idea can be protected. This step often requires professional help from a patent attorney or registered patent agent who can review existing patents and similar products. Skipping this process could lead to costly problems later—especially if you unknowingly infringe on someone else’s patent.

You can find registered intellectual property professionals through the U.S. Patent and Trademark Office website. While this review may cost a few dollars upfront, it can save you significant time, stress, and expense down the road. It’s also smart to request a written opinion from the attorney or agent explaining whether your idea may qualify for patent protection or another form of intellectual property.

Coming up with a strong invention idea—and evaluating whether it’s worth pursuing—takes time, patience, and practice. Developing this skill is much like learning anything new; it becomes easier with experience. Pay attention to your surroundings and how people use everyday products. Ask yourself:

• What could work better?

• What’s frustrating or inefficient?

• How could a simple improvement make a big difference?

Most importantly, try to separate emotion from evaluation. When you come up with an idea, think like a business owner. This is part of the market research and development process. You’re deciding whether to move forward—or move on to the next idea—and both outcomes are valuable steps on your inventor journey.

Joe Weston & The Gutter Grabber

One of our past episodes of Got Invention Show featured Joe Weston, a true example of innovation born from real-world experience.

Joe has been cleaning windows for over 25 years and now serves more than 500 customers through his business, Window Cleaning by Joe. Although his career started in hotel management, Joe decided in 2009 to leave that behind and pursue his own business full-time. By 2010, he was all in—and much happier for it.

While working on rooftops, Joe realized that ladder-on-gutter safety devices on the market just weren’t adequate. Rather than accept the risk, he invented a better solution: The Gutter Grabber, a ladder-on-gutter safety device that he patented himself.

Although the $40-per-unit product isn’t yet on the market, Joe is already enjoying the benefits. By mounting it above the gutter line, he’s much safer while working on roofs—a great reminder that many inventions start with solving a personal problem first.

Joe lives in Sparta with his wife and has two grown sons who, thankfully, never worked for him (his words—LOL).

One of the most transformative inventions in modern history is the telephone — a device that forever changed how people communicate across distances. Don’t Let a Good Idea Sit Still

Can You Protect Your Invention—and What Are Your Options?

Before moving forward with an invention, it’s essential to understand where you stand. A professional patent search with a patentability opinion, combined with your own market research, helps you decide your next steps with clarity and confidence.

But what if the results aren’t what you hoped for?

If your search uncovers a similar or identical patent—or shows that your idea has little to no chance of being patented—it doesn’t mean the journey is over. It simply means you have decisions to make.

Here are your main paths forward:

• Know where you stand. A “no” on patentability isn’t failure—it’s information. With that knowledge, you can decide whether to manufacture the product yourself, pivot, or move on to your next idea.

• Check patent expiration dates. Utility patents last 20 years; design patents last 15 years. If a competing patent has expired (design patents often start with a “D”), the invention may now be in the public domain—opening the door for you to move forward legally.

• Consider manufacturing on your own. Many inventors assume manufacturing is out of reach, but once you speak with factories and understand the real costs, it may be more achievable than you expect. Funding options can include saving over time, loans from friends or family, traditional loans, or even crowdfunding.

• Build value without a patent. Even without patent protection, you can create a strong business by developing a trademarkable brand name—as long as you’re not infringing on an active patent.

• Learn from success stories. The Snuggie is a great example: the underlying product idea was already in the public domain, but the company built massive value through branding and trademark protection.

• Explore partnerships. If a patent is still active, you may be able to partner with the patent holder, license the technology, manufacture for them, or collaborate on an improvement.

• Understand the risks. Filing a provisional patent or moving forward without clear rights can carry legal risks, including cease-and-desist orders or lawsuits. These are strategic decisions that must be weighed carefully.

The bottom line:
Not being able to get a patent does not mean you have to give up. Whether through manufacturing, licensing, trademarks, partnerships, or moving on to a stronger idea, the goal is always the same—find a smart, legal path to turn your creativity into income.

Ultimately, the decision is yours. With the right information, you can choose the path that makes the most sense for you and your invention.

• Infomercial & DRTV Companies: These companies look for mass-market, problem-solution products that can be clearly demonstrated on TV. Study infomercials, pricing, and target audiences before pitching.

• Industry-Specific Companies: Identify leading brands in your product’s industry and learn their invention submission process. Your idea should align with their existing product line.

• Trade Shows: Inventor-friendly trade shows can help you connect with licensees, buyers, and industry leaders while showcasing your invention.

• Catalog Companies: Catalogs buy finished products (not licenses). Be ready with inventory, samples, and shipping timelines. They can be a great launch platform with smaller orders and higher margins.

• TV Shopping Channels: Home shopping networks allow you to test demand quickly. A finished product, strong demo, and clear pricing are essential.

Know your product, know your audience, and think like a marketer. Focus on what’s in it for your potential partner, and choose the marketing path that gives your invention the best chance to succeed.

Trademarks: What is the difference between TM and the R within the circle ®?

Use of the TM and SM symbols may be governed by local, state, or foreign laws and the laws of a pertinent jurisdiction to identify the marks that a party claims rights to. The federal registration symbol, the R enclosed within a circle, may be used once the mark is actually registered in the USPTO. Even though an application is pending, the registration symbol may not be used before the mark has actually become registered.

The federal registration symbol should only be used on goods or services that are the subject of the federal trademark registration.

PLEASE NOTE: Several foreign countries use the letter R enclosed within a circle to indicate that a mark is registered in that country. Use of the symbol by the holder of a foreign registration may be proper.

On February 18, 1879, French sculptor Frédéric‑Auguste Bartholdi secured a U.S. design patent for his monumental creation Liberty Enlightening the World—better known today as the Statue of Liberty. Bartholdi’s use of intellectual property protection helped him safeguard the statue’s unique design during a pivotal fundraising campaign, allowing him and supporters to sell statuettes and images that raised money for the statue’s pedestal and construction. 

Design patents protect the ornamental appearance of an article, making them ideal for artistic works like sculptures, decorative objects, and other visually distinctive creations. For Bartholdi, patenting the statue’s design was a strategic move to prevent unauthorized copies of the statue and related merchandise—a clever early example of using IP to support a major cultural and engineering achievement.

Today, the Statue of Liberty stands not only as an icon of freedom but also as a historical testament to how patent protection can support creative and monumental works.
